By accessing or using SwarmChat ("Service," "Platform," "we," "us," or "our") at swarmchat.farm, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

SwarmChat is an AI-powered Telegram automation platform that enables users to:

• Create AI-powered characters with unique personalities and communication styles
• Design conversation scenarios with customizable topics and moods
• Automate message generation and delivery to Telegram groups
• Manage multiple conversations simultaneously across different groups

The Service uses AI models (OpenAI, Together AI) to generate authentic-looking conversations.

3. User Accounts and Authentication

3.1 Account Creation

To use the Service, you must:

• Connect a Web3 wallet (MetaMask, WalletConnect, Coinbase Wallet)
• Be at least 18 years old
• Provide accurate and complete information
• Maintain the security of your wallet private keys

3.2 Account Security

You are responsible for:

• Keeping your wallet private keys secure
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. Acceptable Use Policy

4.1 Permitted Uses

You may use the Service for:

• Legitimate marketing and community engagement
• Content creation and social media management
• Testing and demonstrating Telegram bots
• Research and educational purposes

4.2 Prohibited Uses

You may NOT use the Service to:

• Spam or Harassment: Send unsolicited messages, spam, or harass users
• Illegal Activities: Engage in fraud, scams, phishing, or illegal activities
• Harmful Content: Distribute malware, viruses, or malicious code
• Impersonation: Impersonate individuals or organizations to deceive others
• Hate Speech: Promote violence, hatred, or discrimination
• Misinformation: Deliberately spread false information for malicious purposes
• Terms Violations: Violate Telegram's Terms of Service or community guidelines
• Unauthorized Access: Attempt to hack, exploit, or compromise the Service
• Market Manipulation: Coordinate pump-and-dump schemes or market manipulation

Important: You are responsible for ensuring your use of the Service complies with all applicable laws, including anti-spam laws, data protection regulations (GDPR, CCPA), and Telegram's Terms of Service.

5. Telegram Accounts and Session Data

5.1 Account Import

You can import Telegram accounts using:

• Session Strings: Exported from authorized Telegram clients
• Phone Number: With SMS verification code

5.2 Your Responsibilities

You certify that:

• You own or have authorization to use the Telegram accounts you import
• Accounts were obtained through legitimate means
• You will comply with Telegram's Terms of Service
• You will not use compromised, stolen, or unauthorized accounts

5.3 Account Risks

Warning: Using automation with Telegram accounts carries risks:

• Telegram may limit or ban accounts for suspicious activity
• Excessive messaging may trigger rate limits or spam filters
• Groups may ban bots or automated accounts

We are not responsible for any consequences to your Telegram accounts, including bans or restrictions.

6. Credits and Payments

6.1 Credit System

The Service uses a credit-based system for AI generation and automation features:

• Message Generation: 0.5 credits per message
• AI Scenario Generation: 1 credit
• Website Extraction: 3 credits
• Telegram Group Analysis: 5 credits

6.2 Payments

Payments are processed via cryptocurrency through Bitgo:

• All payments are final and non-refundable
• Credits do not expire
• Minimum purchase amounts may apply
• Transaction fees are paid by the sender

6.3 Refunds

We do not offer refunds for purchased credits. However, if you experience technical issues that prevent you from using the Service, contact support for assistance.

7. Intellectual Property

7.1 Our Rights

We own all rights to:

• The SwarmChat platform, code, and technology
• SwarmChat branding, logos, and trademarks
• Documentation and user interface

7.2 Your Content

You retain ownership of content you create (characters, scenarios, generated messages). By using the Service, you grant us:

• A license to use your content to provide the Service
• Permission to process your data through third-party AI services
• Right to display anonymized, aggregated usage statistics

8. Third-Party Services

The Service integrates with third-party providers:

• Telegram API: For message delivery
• AI Services: For text generation
• Bitgo: For cryptocurrency payments

You agree to comply with the terms of service of these third-party providers. We are not responsible for their actions or service availability.

9. Service Availability and Modifications

9.1 Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

9.2 Modifications

We reserve the right to:

• Modify or discontinue features
• Update pricing and credit costs
• Change API rate limits
• Suspend or terminate the Service

We will provide reasonable notice of significant changes when possible.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

• Merchantability and fitness for a particular purpose
• Uninterrupted, error-free, or secure operation
• Accuracy or reliability of AI-generated content
• Compatibility with Telegram or third-party services

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Telegram account bans, restrictions, or suspensions
• Actions taken by third-party services (Telegram, AI providers)
• Unauthorized access or data breaches
• Errors in AI-generated content

Our total liability shall not exceed the amount you paid for credits in the past 12 months.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of third-party rights
• Content you create or messages you send
• Your violation of Telegram's Terms of Service

13. Termination

13.1 By You

You may delete your account at any time. Unused credits will be forfeited upon account deletion.

13.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your use harms the Service or other users
• Required by law or government authority

We will provide notice when possible, but reserve the right to terminate immediately for serious violations.

14. Dispute Resolution

14.2 Governing Law

These Terms are governed by the laws of the jurisdiction where our company is registered, without regard to conflict of law provisions.

We may update these Terms from time to time. We will notify you of significant changes by:
